This mechanism, often misinterpreted as an automatic international arrest warrant, plays a key role in cooperation between States to locate and provisionally arrest persons wanted for the commission of serious crimes.<\/p>\n\n\n\n<p>However, the improper or abusive use of these notices can have devastating consequences for the fundamental rights of the individuals concerned, especially when they are activated for political or persecutory purposes or without sufficient legal basis. In this article we explain what a Red Notice is, how it works, how it differs from an international arrest warrant, and - most importantly - how it can be misused. <strong>how to contest<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What is an INTERPOL Red Notice?<\/strong><\/h2>\n\n\n\n<p>A Red Notice is a notice that is <strong>international search request<\/strong> issued by the INTERPOL General Secretariat at the request of one of its member countries. Its purpose:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Locate a person wanted by the justice system;<\/li>\n\n\n\n<li>Provisionally detain it;<\/li>\n\n\n\n<li>Facilitate their extradition at the request of the State issuing the alert.<\/li>\n<\/ul>\n\n\n\n<p><strong>This is not a binding arrest warrant.<\/strong>but of a <strong>international alert<\/strong> that each State may execute in accordance with its national legislation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Requirements and procedure for issuance<\/strong><\/h2>\n\n\n\n<p>To issue a Red Notice, the requesting country must:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>To have a <strong>valid arrest warrant<\/strong> issued by a competent judicial authority;<\/li>\n\n\n\n<li>Send a detailed request to the INTERPOL General Secretariat in Lyon, France;<\/li>\n\n\n\n<li>Justify that the crime for which the individual is wanted is of international relevance and complies with the principles of INTERPOL's Constitution.<\/li>\n<\/ol>\n\n\n\n<p>The General Secretariat evaluates whether the request complies with the requirements of the <strong>internal rules<\/strong> of INTERPOL, in particular the <strong>Article 3 of the Bylaws<\/strong>which prohibits acting in matters of a political, military, religious or racial nature.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Differences between Red Notice and European Arrest Warrant<\/strong><\/h2>\n\n\n\n<p>Although both seek to facilitate the arrest and extradition of individuals, there are fundamental differences:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th class=\"has-text-align-center\" data-align=\"center\"><strong>Feature<\/strong><\/th><th class=\"has-text-align-center\" data-align=\"center\"><strong>Red Notice (INTERPOL)<\/strong><\/th><th class=\"has-text-align-center\" data-align=\"center\"><strong>European Arrest Warrant (EAW)<\/strong><\/th><\/tr><\/thead><tbody><tr><td class=\"has-text-align-center\" data-align=\"center\">Legal nature<\/td><td class=\"has-text-align-center\" data-align=\"center\">Non-binding<\/td><td class=\"has-text-align-center\" data-align=\"center\">Judicial and binding<\/td><\/tr><tr><td class=\"has-text-align-center\" data-align=\"center\">Emitter<\/td><td class=\"has-text-align-center\" data-align=\"center\">Member country through INTERPOL<\/td><td class=\"has-text-align-center\" data-align=\"center\">Judicial authority of an EU member state<\/td><\/tr><tr><td class=\"has-text-align-center\" data-align=\"center\">Scope<\/td><td class=\"has-text-align-center\" data-align=\"center\">World Cup<\/td><td class=\"has-text-align-center\" data-align=\"center\">European Union<\/td><\/tr><tr><td class=\"has-text-align-center\" data-align=\"center\">Legality control<\/td><td class=\"has-text-align-center\" data-align=\"center\">INTERPOL General Secretariat<\/td><td class=\"has-text-align-center\" data-align=\"center\">National courts of the requested country<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Frequent problems and abuses of the system<\/strong><\/h2>\n\n\n\n<p>In recent years, a number of international organizations and human rights defenders have denounced the <strong>misuse of Red Notices<\/strong> by authoritarian regimes or regimes with deficient judicial systems. Some examples:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Use to persecute political dissidents;<\/li>\n\n\n\n<li>Requests based on unwarranted legal proceedings;<\/li>\n\n\n\n<li>Requests that do not respect the principle of dual criminality.<\/li>\n<\/ul>\n\n\n\n<p>This has led to INTERPOL, through its <strong>File Control Commission (CCF)<\/strong>strengthen review and oversight mechanisms, enabling those affected to <strong>may request the cancellation of the notification<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>How to contest a Red Notice?<\/strong><\/h2>\n\n\n\n<p>The affected person may present a <strong>request for cancellation or correction<\/strong> of the Red Notice to the CCF of INTERPOL, alleging, among other reasons:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Absence of legality in the national arrest warrant<\/strong>;<\/li>\n\n\n\n<li><strong>Violation of fundamental rights<\/strong>such as the right to due process or asylum;<\/li>\n\n\n\n<li><strong>Political or discriminatory nature of criminal prosecution<\/strong>;<\/li>\n\n\n\n<li><strong>Statute of limitations for criminal action or enforcement of sentence<\/strong>;<\/li>\n\n\n\n<li><strong>Lack of proportionality or seriousness of the crime charged<\/strong>.<\/li>\n<\/ol>\n\n\n\n<p>This process is confidential and may take several months.
