They face a growing demand, increasingly scrutinized by the international community: to ensure that no serious crime goes unpunished, even when the classic mechanisms of transnational criminal prosecution - such as extradition - do not succeed.<\/p>\n\n\n\n<p>This principle, known in international law as the principle of non-impunity, has ceased to be a doctrinal aspiration and has become an operational standard. Its concrete application today determines the credibility, reputation and positioning of States before international organizations, supranational courts and global public opinion itself.<\/p>\n\n\n\n<p>This article analyzes, from the perspective of international criminal law in force in Spain, how a requesting State should act when its extradition request has been denied, what legal mechanisms exist to avoid impunity and why having specialized advice is crucial to redirect the procedure effectively and legitimately.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">I. The refusal of extradition does not close the case.<\/h2>\n\n\n\n<p>In international practice, it is increasingly common for an extradition request to be denied by the requested State. The reasons are not always due to the lack of criminal grounds for the acts charged. In many cases, the refusal is for reasons related to the protection of fundamental rights:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Risk of violation of due process guarantees in the requesting State.<\/li>\n\n\n\n<li>Inadequacy of the guarantees offered with respect to the right to a fair trial.<\/li>\n\n\n\n<li>Risk of the death penalty, torture, or inhuman or degrading treatment.<\/li>\n\n\n\n<li>Underlying political motivation in criminal prosecution.<\/li>\n\n\n\n<li>International human rights standards that the requested State is obliged to respect.<\/li>\n<\/ul>\n\n\n\n<p>In Spain, <a href=\"https:\/\/www.poderjudicial.es\/cgpj\/es\/Poder-Judicial\/Audiencia-Nacional\/\">the Audiencia Nacional<\/a> apply these criteria rigorously when resolving extradition requests, in accordance with Law 4\/1985 on Passive Extradition, the Spanish Constitution, and the international commitments undertaken by the Spanish State in matters of human rights, particularly the European Convention on Human Rights (ECHR).<\/p>\n\n\n\n<p>Faced with this scenario, many States make a strategic error with grave consequences: they consider that the denial of extradition is equivalent to closing the case.<\/p>\n\n\n\n<p><strong>That's not the case. International law requires an additional response.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">II. The principle of non-impunity: an operational obligation, not a rhetorical one.<\/h2>\n\n\n\n<p>The principle of non-impunity is one of the fundamental pillars of contemporary international criminal law. Its consecration is not merely doctrinal; it is enshrined in multiple binding international instruments:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Preamble and Article 17 of the Rome Statute of the International Criminal Court state that impunity for the most serious crimes is incompatible with the international legal order.<\/li>\n\n\n\n<li>The American Convention on Human Rights, in its Article 25, obligates States to guarantee effective judicial remedies that prevent impunity.<\/li>\n\n\n\n<li>Article 13 of the European Convention on Human Rights enshrines the right to an effective remedy, the interpretation of which by the European Court of Human Rights (ECtHR) requires real diligence on the part of the State in the prosecution of serious crimes.<\/li>\n\n\n\n<li>The bilateral extradition treaties signed by Spain with numerous countries include specific mechanisms designed to prevent the denial of an extradition from creating situations of impunity.<\/li>\n<\/ul>\n\n\n\n<p>In practical terms, the principle of non-impunity obliges States to activate alternative mechanisms of criminal prosecution when extradition is exhausted, to cooperate actively with other jurisdictions, to demonstrate diligence before the international community and to protect fundamental rights without blocking the action of justice.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">III. The mechanism of Article 7.2 of the bilateral treaties: the path that States must be aware of<\/h2>\n\n\n\n<p>Multiple bilateral extradition treaties signed by Spain contain a clause of enormous legal and diplomatic value that is often underutilized or completely unknown by the requesting states.<\/p>\n\n\n\n<p>An illustrative example can be found in Article 7.2 of various bilateral extradition treaties signed by Spain with Latin American countries, the content of which provides, in substantially identical terms, the following:<\/p>\n\n\n\n<p><em>When extradition is denied for any of the anticipated causes, the requested Party, at the request of the requesting Party, shall submit the matter to its competent authorities so that, if deemed appropriate under its legal system, the exercise of criminal prosecution may be considered, and the requesting Party shall provide the available evidence and proof.<\/em><\/p>\n\n\n\n<p>This provision establishes a mechanism of enhanced judicial cooperation that operates as an alternative to extradition and reflects the bilateral commitment of both States to the principle of non-impunity.<\/p>\n\n\n\n<p>Similar clauses are found in numerous bilateral extradition treaties linking Spain with countries in Latin America and other regions. Their activation is not automatic: it requires a formal, motivated and technically sound request from the requesting State.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">IV. Scope and Limits: What It Allows and What It Does Not Guarantee<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">A. Legal effects resulting from the activation of the mechanism<\/h3>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Formulate a formal and reasoned request to the requested State expressly invoking the cooperation clause of the bilateral treaty.<\/li>\n\n\n\n<li>Submit a complete, structured and technically sound criminal file, including court decisions, indictments, evidence and relevant factual context.<\/li>\n\n\n\n<li>To demonstrate, before the international community, diligent and responsible action in the prosecution of serious crimes, in accordance with the principles of judicial cooperation and respect for human rights.<\/li>\n\n\n\n<li>Request that the authorities of the requested State assess the prosecution in accordance with its own legal system.<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading\">B. Inherent Limitations of the Mechanism<\/h3>\n\n\n\n<p>The activation of this clause does not imply, by itself:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The automatic opening of criminal proceedings in Spain.<\/li>\n\n\n\n<li>The application of the penal legislation of the requesting State by Spanish courts.<\/li>\n\n\n\n<li>The assumption of jurisdiction by the National High Court or other Spanish judicial bodies without the concurrence of valid criteria of criminal jurisdiction under Spanish law.<\/li>\n<\/ul>\n\n\n\n<p>Spanish courts may only exercise criminal jurisdiction based on the criteria recognized by the Spanish legal system: territoriality, active or passive personality, protection of essential interests of the State or the cases of extraterritorial jurisdiction expressly provided for in the Organic Law of the Judiciary (LOPJ).<\/p>\n\n\n\n<p>Consequently, the Spanish authorities can legitimately analyze the submitted file and, if they deem it appropriate, decide not to initiate criminal proceedings due to lack of jurisdiction, without this constituting any breach of the treaty.<\/p>\n\n\n\n<p><strong>Therefore, the preparation of the file and the presentation strategy are crucial.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">V. The value of a well-designed legal strategy: the difference between impunity and justice<\/h2>\n\n\n\n<p>Experience in international criminal cooperation procedures shows a reality that states must clearly understand: the difference between a case that is closed and a case that remains internationally active is not essentially legal. It is strategic.<\/p>\n\n\n\n<p>A state that acts with precision, anticipation, and technical rigor:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Prepare a solid evidentiary file, tailored to the standards of the required country.<\/li>\n\n\n\n<li>Anticipate the admissibility and jurisdiction criteria of the foreign legal system.<\/li>\n\n\n\n<li>Articulate judicial cooperation in a technical, efficient, and professional manner.<\/li>\n\n\n\n<li>Manages its institutional positioning before international organizations.<\/li>\n\n\n\n<li>Project an image of seriousness, legality, and commitment to the rule of law.<\/li>\n<\/ul>\n\n\n\n<p>On the contrary, a lack of structure, improvisation, or absence of specialized advice can lead to serious consequences:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Loss of institutional credibility before the international community.<\/li>\n\n\n\n<li>Diplomatic pressure and adverse narratives of political persecution.<\/li>\n\n\n\n<li>Scenarios of impunity that weaken the State's position in the long term.<\/li>\n\n\n\n<li>Irreversible reputational damage to the institutions involved.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">VI.
