Not only is a person's freedom at stake: the guarantees of a fair trial, the risk of treatment incompatible with European standards, and often a political and diplomatic dimension that no purely technical file can ignore are at stake.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For a businessperson, investor, or executive with interests in Asia, this is not theory. Business operations, corporate disputes, or white-collar crime investigations can lead to a formal extradition request. What happens if Hong Kong, not Beijing, is the one making the claim?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The reassuring answer is that Spanish law offers a framework of demanding guarantees, with limits that cannot be overstepped and very specific lines of defense. But it is also a terrain where details decide, and where a misstep can be costly. It's advisable to understand it before you need it.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Is there an extradition treaty between Spain and China?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Yes. The extradition treaties between both countries are governed by the <strong>Treaty on Extradition between the Kingdom of Spain and the People's Republic of China, done at Madrid on November 14, 2005<\/strong> (BOE No. 75, March 28, 2007). When a person is arrested in Spain at the request of China, that treaty is also supplemented by the <strong>Law 4\/1985, of March 21, on Passive Extradition<\/strong>, and with the constitutional framework of <strong>Article 13.3 of the Spanish Constitution<\/strong>, which subjects all extradition to treaties and law, under the principle of reciprocity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is a modern treaty, with twenty-one articles, built on mutual respect for sovereignty. But its modernity does not make it automatic: precisely because it details the reasons for which the handover <strong>must<\/strong> o <strong>can<\/strong> refuse, offers a precise map of where the defense is being fought.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">China can request your extradition for crimes such as theft, fraud, bribery, drug trafficking, murder, and espionage.<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The treaty is based on the principle of <strong>dual criminality<\/strong>Extradition is only granted when the act is criminalized in both countries. It also requires a threshold of severity: a prison sentence of over one year when extradition is sought for prosecution, or at least a six-month outstanding sentence when extradition is sought for serving a sentence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As is the case with these instruments, it does not matter if the offense receives a different designation or is classified into different categories in each country; what matters is that the conduct, in its substance, is criminal in both. Here again, the defense's first task is to ascertain whether the specific act\u2014stripped of its foreign classification\u2014truly fits into the <a href=\"https:\/\/boe.es\/buscar\/act.php?id=BOE-A-1995-25444&amp;tn=2&amp;p=20211109\">Spanish Penal Code<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The Hong Kong Knot: Can Hong Kong extradite me from Spain?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is the most delicate question, and where Spanish jurisprudence has set a criterion of enormous value for the defense.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hong Kong is a Special Administrative Region of the People's Republic of China, with its own legal status. The problem is that <strong>The 2005 Extradition Treaty links the States: Spain and the People's Republic of China<\/strong>. A request directly from Hong Kong authorities, without Beijing's intervention, poses a significant legal coverage issue.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Constitutional Court addressed it head-on in its <strong>Judgment 31\/2013, of February 11 (Second Chamber)<\/strong> (Official State Gazette of March 12, 2013). The case was illustrative: a Portuguese citizen arrested in Spain pursuant to an international warrant issued by the authorities of Hong Kong. The National Court had granted the extradition based on, among other instruments, the United Nations Convention against Corruption, reasoning that Hong Kong, without being a State, operated as a sort of \u00abquasi-state\u00bb with broad international powers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Constitutional Court <strong>granted the injunction<\/strong>. It is appreciated that the rights to effective judicial protection (Article 24.1 of the Constitution), in relation to the principle of legality in extradition matters (Article 13.3 of the Constitution), and to liberty (Article 17 of the Constitution) had been violated, because the request was processed and granted at the behest of the Hong Kong Special Administrative Region. <strong>without the assistance or authorization of the People's Republic of China<\/strong>, and therefore without the legal or conventional coverage that delivery requires. The ruling was accompanied by a dissenting opinion, which gives an idea that the legal debate was genuine and sophisticated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The practical lesson is striking: <strong>The enabling title matters as much as the background.<\/strong>. Who claims, with what sovereignty, and under what instrument are not technicalities; they are often the first and most effective line of defense against a request related to Hong Kong.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What grounds can my defense invoke to prevent extradition?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The treaty clearly distinguishes, in a way that is useful, between grounds for refusal <strong>Mandatory<\/strong> y <strong>discretionary<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Among the <strong>Mandatory<\/strong> (Article 3), extradition <em>must<\/em> to be denied, among other assumptions, when:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The crime is <strong>political nature<\/strong> (with the express exception of terrorism, which does not receive such consideration).<\/li>\n\n\n\n<li>There are valid reasons to believe that the request seeks <strong>To persecute or punish a person for their race, sex, religion, nationality, or political opinions<\/strong>, so that your position in the process may be jeopardized for any of those reasons. It is the non-discrimination clause, decisive in scenarios of covert persecution.<\/li>\n\n\n\n<li>The person sought is <strong>national of the respondent<\/strong>. Spain is therefore not obliged to extradite its nationals to China; it is a mandatory ground for refusal.<\/li>\n\n\n\n<li>The criminal action or the penalty have <strong>prescribed<\/strong> in accordance with Spanish law. (A relevant nuance: unlike other more recent treaties, here the statute of limitations under Spanish law does operate as a mandatory cause for denial.)<\/li>\n\n\n\n<li>Media <strong>res judicata<\/strong>, in absentia conviction without guarantees of a new trial, or risk of <strong>death penalty<\/strong> without sufficient guarantees that it will not be imposed or enforced.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Among the <strong>discretionary<\/strong> (Article 4), Spain <em>can<\/em> deny delivery when it has its own jurisdiction and will pursue the act, when the person has already been judged in a third State, or when extradition would be incompatible with <strong>humanitarian considerations<\/strong> taking into account the age, health, or other circumstances of the claimant.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Each of these grounds is a door. Knowing which one to open, with what evidence, and at what procedural stage, is precisely the job.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Human rights and European standards: the limit that no treaty surpasses<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Above the bilateral agreement is a guarantee that Spain cannot surrender: the <strong>Article 3 of the European Convention on Human Rights<\/strong>, which prohibits torture and inhuman or degrading treatment. Since the doctrine established by the European Court of Human Rights in <em>Soering v. United Kingdom<\/em> (1989), a European State may not surrender a person if there is a real risk that they will be subjected to that type of treatment in the requesting country.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the Chinese context, this guarantee carries particular weight. Issues concerning detention conditions, fair trial guarantees, and the application of capital punishment for certain crimes\u2014including some of an economic nature\u2014 necessitate rigorous scrutiny. The treaty itself anticipates this by requiring safeguards against the death penalty (Article 3(h)). A strong defense is not limited to generally invoking these risks; it substantiates them, documents them, and applies them to the specific situation of the claimant.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What if Spain has already extradited to China? A note of realism<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">It's worth being honest: Spain has granted extraditions to the People's Republic of China.
