Of all the extradition scenarios, the one involving Iran is probably the most delicate. Not only because of the distance between the legal systems, but because the three factors that most strain an extradition are present at the same time: the absence of a treaty, a serious context of risk to human rights, and a political and diplomatic dimension impossible to ignore.<\/p>\n\n\n\n

For a businessman, investor, or executive with interests in the Middle East, this is not a remote hypothesis. Trade disputes, economic crime investigations, or conflicts with authorities can result in an extradition request. And when that happens, the question that governs everything is not just \u00abis extradition warranted?\u00bb, but \u00abwhat guarantees would Iran have to offer for Spain to even consider it?\u00bb.<\/p>\n\n\n\n

The reassuring answer is that, in this scenario, Spanish law sets the bar very high. But it's important to understand why, because here more than in any other case, the defense hinges on guarantees and fundamental rights.<\/p>\n\n\n\n

Is there an extradition treaty between Spain and Iran?<\/h2>\n\n\n\n

No. Spain does not have a bilateral extradition treaty with Iran, nor is Iran a party to the European Convention on Extradition of 1957. We are, therefore, in the pure case of absence of treaty<\/strong>.<\/p>\n\n\n\n

This does not mean that extradition is legally impossible, but it radically changes the rules of the game. In the absence of a treaty, the applicable framework is essentially internal: the Article 13.3 of the Spanish Constitution<\/strong>, which requires extradition to be granted \u00abin accordance with a treaty or the law, respecting the principle of reciprocity,\u00bb and the Law 4\/1985, of March 21, on Passive Extradition<\/strong> (Official State Gazette No. 73, of March 26, 1985).<\/p>\n\n\n\n

The unwritten golden rule: reciprocity and guarantees<\/h2>\n\n\n\n

When there is no treaty, Law 4\/1985 is clear: extradition will only be granted based on the principle of reciprocity<\/strong>, and the Government can demand reciprocity<\/strong> to the requesting State. That is to say, Spain is not obligated to extradite; it can do so, but under conditions that it sets and evaluates with a demanding standard.<\/p>\n\n\n\n

And there is a second decisive feature: in the absence of a treaty, the granting of extradition is discretionary<\/strong>. The preamble of the law itself states this clearly, explaining that because no binding treaty exists, Spain \u00abmay freely decide on each extradition request.\u00bb In addition, the Government has the power to Do not proceed with delivery<\/strong>, even if the Court had considered it admissible, for reasons of sovereignty, security, public order, and other Spanish interests.<\/p>\n\n\n\n

In practice, this places an Iranian request in a very fragile starting position: without a treaty, without verified reciprocity, and with ample room for denial by both the judiciary and the government.<\/p>\n\n\n\n

The True Battlefield: Guarantees vs. Fundamental Rights<\/h2>\n\n\n\n
