States retain primary responsibility for investigating and prosecuting, and the intervention of the Court depends on the conditions of jurisdiction and admissibility provided for in the Statute itself.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Based on this premise, the paper examines the three ways in which the jurisdiction of the International Criminal Court can be triggered:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the referral of a situation by a State Party;<\/li>\n\n\n\n<li>the referral by the United Nations Security Council;<\/li>\n\n\n\n<li>the Prosecutor's proprio motu action, subject to the judicial control provided for in the Rome Statute.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The paper also analyzes the mechanisms that allow States to defend their jurisdiction, the admissibility of cases, and the avenues recognized for victims within the system.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>No individual directly triggers the jurisdiction of the Court.<\/em><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Understanding who can open that door\u2014and under what conditions\u2014is essential for any person, company, or institution with international exposure.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Venezuela and the Philippines: two living situations<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The analysis relies particularly on two current situations. The first is Venezuela I, regarding which Dr. Aldana has had direct professional experience.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The second is the Philippines, used as a case study to examine, among other issues, the effect of an international arrest warrant and the guarantees that must operate when criminal prosecution crosses different jurisdictions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The use of real-life situations makes it possible to shift the debate from the theory of the Rome Statute to a more practical question: what happens to a person's fundamental rights when an international investigation begins to produce effects outside The Hague.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The main risk may appear before reaching the Court<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is one of the central ideas of the intervention. Within the International Criminal Court, there is a developed procedural system of guarantees: presumption of innocence, right to a defense, disclosure of certain evidence favorable to the accused, judicial control, and appeal mechanisms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the problem can begin before the person physically arrives at the Court.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>INTERPOL.<\/li>\n\n\n\n<li>Extradition or surrender procedures.<\/li>\n\n\n\n<li>International sanctions.<\/li>\n\n\n\n<li>Financial constraints.<\/li>\n\n\n\n<li>International or private bases of risk and reputation.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">It is in that space where a person can experience mobility restrictions, banking issues, or reputational consequences before there is a final decision regarding their criminal liability.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The legal challenge consists precisely in preventing the internationalization of prosecution from resulting in a reduction of guarantees.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">INTERPOL, extradition and sanctions: the defense begins before trial<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">That transnational space coincides with a significant part of VENFORT Abogados' practice.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>INTERPOL Red Notices and Diffusions;<\/li>\n\n\n\n<li>proceedings before the INTERPOL Commission for the Control of Files;<\/li>\n\n\n\n<li>extraditions and international criminal cooperation;<\/li>\n\n\n\n<li>international sanctions;<\/li>\n\n\n\n<li>preventive strategies for executives, business owners, high-net-worth families, and officials with international exposure.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Experience shows that these matters rarely belong exclusively to a single jurisdiction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An order can originate in a country.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The localization will occur in another.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Detention in a third party.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The extradition must be discussed before another court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And its financial consequences appear in a completely different State.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, early coordination between lawyers from different jurisdictions can be as important as the defense in the main proceedings.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>A constitutional issue, not just an international one<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The paper will transfer this problem to the appropriate terrain for a Congress organized by a Constitutional Court:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>What happens to constitutional guarantees when punitive power ceases to act within the borders of a single State?<\/em><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Contemporary constitutionalism has developed very precise instruments to limit domestic criminal power.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The current challenge consists in ensuring that these same guarantees accompany the person when the persecution moves from one jurisdiction to another.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>The internationalization of criminal proceedings requires the internationalization of constitutional safeguards.<\/em><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And its practical consequence is equally simple:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Because borders have disappeared for criminal prosecution. It begins when the risk arises.<\/em><\/strong><\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-style-default has-background is-layout-flow wp-block-quote-is-layout-flow\" style=\"background-color:#fafafa\">\n<div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\">Is there any international exhibition that requires a preliminary assessment?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">When a matter can simultaneously produce consequences before INTERPOL, extradition courts, the International Criminal Court, or international sanctions regimes, waiting for an arrest or a border incident to occur can significantly reduce the available options.<\/p>\n\n\n\n<div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n<\/blockquote>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Frequently asked questions<\/strong><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">How do you access the International Criminal Court?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Article 13 of the Rome Statute provides for three main triggers: the referral of a situation by a State Party, the referral by the United Nations Security Council, and the proprio motu action of the Prosecutor within the framework and controls established by the Statute. No individual directly triggers the jurisdiction of the Court.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Can a person go directly to the International Criminal Court?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Not in the sense of directly triggering its jurisdiction. Victims and other persons may provide information and participate in certain phases, but the triggering of jurisdiction is subject to the mechanisms provided for in the Rome Statute.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">What relationship can exist between the International Criminal Court and INTERPOL?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The enforcement of international decisions may require cooperation among States and police cooperation mechanisms. INTERPOL can play a relevant role in the international circulation of certain police information, but it is not a court nor does it decide on guilt.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Why can a preventive defense be important?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Because the initial consequences of an international situation may arise before the individual appears before the competent court: travel restrictions, detention, extradition, banking relationships, or international reputation.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Where will the full paper be
