{"id":2456,"date":"2020-08-25T08:00:00","date_gmt":"2020-08-25T12:00:00","guid":{"rendered":"https:\/\/venfort.com\/blog\/?p=1243"},"modified":"2020-08-25T08:00:00","modified_gmt":"2020-08-25T12:00:00","slug":"es-delito-reunirse-en-cuarentena","status":"publish","type":"post","link":"https:\/\/venfort.com\/es\/es-delito-reunirse-en-cuarentena\/","title":{"rendered":"\u00bfEs delito reunirse en cuarentena?"},"content":{"rendered":"\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>En los \u00faltimos d\u00edas, hemos visto noticias sobre la detenci\u00f3n de personas por congregarse en recintos cerrados para realizar fiestas o reuniones, denominadas por la prensa como \u00ab<em>Corona Parties<\/em>\u00bb, que a pesar <a href=\"https:\/\/venfort.com\/blog\/medidas-para-frenar-a-covid-19-deben-garantizar-derechos-humanos\/\">de las restricciones existentes decretadas por las autoridades<\/a> debido a la pandemia, han sido recurrentes en las distintas ciudades afectadas durante la cuarentena, generando multas y en algunos casos detenciones de los participantes.<\/p><\/blockquote>\n\n\n\n<p><strong>Ahora bien, cabe preguntarse: <\/strong>\u00bfreunirse en franca violaci\u00f3n del decreto presidencial, municipal o regional constituye un delito?, \u00bfes legal detener a las personas por reunirse clandestinamente en grupos sin las medidas de bioseguridad necesarias para evitar el contagio?, \u00bfcu\u00e1l ser\u00eda el estatus legal de las personas que incumplan la cuarentena obligatoria decretada?<\/p>\n\n\n\n<p><strong>En primer lugar, debemos decir que reunirse inobservando la prohibici\u00f3n establecida<\/strong> por Decretos a nivel mundial que prev\u00e9 la cuarentena obligatoria, <strong>no es delito<\/strong>, sino que la conducta es at\u00edpica, y debemos se\u00f1alar adem\u00e1s que aun cuando existen conductas que nos pueden parecer aberrantes o dantescas, al no estar establecidas previamente en la norma penal como un hecho punible, no pueden calificarse como delito (<a href=\"https:\/\/es.wikipedia.org\/wiki\/Principio_de_legalidad\" target=\"_blank\" rel=\"noreferrer noopener\">Principio de Legalidad<\/a>), <em>ergo<\/em> el principio de m\u00ednima intervenci\u00f3n que establece como la \u00faltima <em>ratio<\/em> para resolver controversias dentro de la sociedad al derecho penal, como ejemplo de ello tenemos el caso Espa\u00f1ol; que durante el estado de alarma en Madrid, se impon\u00edan multas a los infractores con montos que oscilan entre 600 y 10.000 euros.<\/p>\n\n\n\n<p><strong>Se ha legitimado una mala pr\u00e1ctica de los \u00f3rganos de seguridad de algunos Estados<\/strong> en la cual se pretende criminalizar una conducta que tiene un orden social primario y no ha sido considerada por el legislador para ser penalizada. En la pr\u00e1ctica, las personas son aprehendidas y presentadas en audiencias ante tribunales penales, imput\u00e1ndose delitos de resistencia a la autoridad o ultraje a funcionario p\u00fablico, delitos estos que no tienen relaci\u00f3n alguna con los hechos de fondo, sin embargo, son aplicados colateralmente como un medio disuasivo para generar temor en otros grupos de la poblaci\u00f3n y de esa manera evitar que se repita la conducta.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Venezuela: reunirse en cuarentena\u00a0<\/h2>\n\n\n\n<p><strong>En Venezuela, las reuniones \u00abilegales\u00bb en la cuarentena constituyen una falta penal conocida como desobediencia a la autoridad<\/strong>, prevista y sancionada en el art\u00edculo 483 del C\u00f3digo Penal vigente, la misma subsume la conducta del infractor de la siguiente forma: \u00ab<em>El que hubiere desobedecido una orden legalmente expedida por la autoridad competente o no haya observado alguna medida legalmente dictada por dicha autoridad en inter\u00e9s de la justicia o de la seguridad o salubridad p\u00fablicas, ser\u00e1 castigado con arresto de cinco a treinta d\u00edas, o multa de veinte unidades tributarias (20 U.T.) a ciento cincuenta unidades tributarias (150 U.T.).<\/em>\u00bb<\/p>\n\n\n\n<p><strong>Ahora bien, en el caso Venezolano, es menester se\u00f1alar un principio b\u00e1sico del derecho penal<\/strong> que establece como requisito fundamental para decretar medidas de coerci\u00f3n personal, que exista un hecho punible que merezca pena privativa de libertad (art 236 n\u00b0 1 del COPP), por lo tanto, estos procedimientos deben llevarse para el encausado en total libertad. Adem\u00e1s de ello, el procedimiento por falta es especial y se lleva ante los tribunales de Juicio, por lo cual no opera la aprehensi\u00f3n en flagrancia.<\/p>\n\n\n\n<p><strong>Tal vez las regulaciones de car\u00e1cter administrativo no puedan contener los l\u00edmites de nuestra sociedad <\/strong>y se haga necesario sancionar nuevas conductas, sin embargo esta situaci\u00f3n nos coloca como sociedad en la disyuntiva de invertir en educaci\u00f3n y siembra de conciencia para fortalecer el sistema de faltas y multas pecuniarias o sancionar penalmente conductas como m\u00e9todo cl\u00e1sico de control social.<\/p>\n\n\n\n<h3 class=\"has-text-align-center wp-block-heading\">Finalmente, en el escritorio jur\u00eddico Alan Aldana &amp;
